LEGAL NOTICE: NON-DELEGABLE RESPONSIBILITY OF THE REMOTE PILOT

FlightLedger is an operational management, risk assessment, and record-keeping software tool designed to assist Remotely Piloted Aircraft Operator's Certificate (ReOC) holders, Remote Pilot Licence (RePL) holders, and excluded category operators in maintaining compliance records.

FLIGHTLEDGER IS NOT AN AUTONOMOUS FLIGHT CONTROLLER, AIR TRAFFIC MANAGEMENT SYSTEM, OR STATUTORY REGULATORY AUTHORITY.

Under the Civil Aviation Act 1988 (Cth) and Civil Aviation Safety Regulations 1998 (CASR) Part 101, the Remote Pilot in Command (RPIC) and the Chief Remote Pilot (CRP) retain absolute, non-delegable legal responsibility for the planning, airworthiness, safety, and physical operation of every flight.

📡 Not an Airservices / NAIPS Substitute

FlightLedger does not deliver certified aeronautical briefings, Air Traffic Control (ATC) clearances, or real-time military airspace activation notices. Remote pilots must independently check official Airservices Australia NAIPS briefings, NOTAMs, and CASA-verified airspace apps before launching.

🌦️ Meteorological Independence

Weather information, wind limits, and visibility indicators in the system are advisory only. The RPIC must independently verify micro-meteorology, wind shear, cloud base, GPS satellite geometry (PDOP/KP-index), and local conditions at the ground control station prior to takeoff.

🔋BMS & Battery Safety Limits

Automated battery cycle warnings and quarantine flags are calculated from logged telemetry. The operator must physically inspect all lithium polymer (LiPo) and lithium-ion packs for swelling, mechanical damage, cell voltage balance, and connector degradation.

🔧 Physical Airframe Airworthiness

A "Serviceable" digital badge in FlightLedger does not replace the mandatory physical pre-flight walkaround, propeller security check, firmware check, motor bearing inspection, and link failsafe verification mandated by manufacturer manuals and CASR 101.

1. Standard Operating Conditions under CASR Part 101

Unless specifically authorized by a CASA instrument, approval, or specific ReOC operations manual endorsement, every commercial and recreational RPAS operator must strictly adhere to the standard operating conditions set out in CASR Part 101:

  • Visual Line of Sight (VLOS): Must fly in visual line of sight during day operations only (unless holding CASA night approval such as Instrument 01-17 / 39-23).
  • Maximum Operating Altitude: Must not operate higher than 120 metres (400 feet) above ground level (AGL).
  • Distance from Non-Operating Persons: Must keep the RPA at least 30 metres away from people not directly involved in operating the aircraft.
  • Controlled & Non-Controlled Aerodromes: Must not operate within 3 nautical miles (5.5 km) of a controlled aerodrome or within approach/departure paths without appropriate clearances.
  • Populous Areas: Must not operate over populous areas where, if a failure occurs, the aircraft could create a hazard to persons or property.
  • Emergency Operations: Must immediately yield right-of-way and ground aircraft during bushfire fighting, police operations, or state emergency services activities.

2. Role of the Chief Remote Pilot (CRP)

For ReOC holder organisations, FlightLedger provides automated compliance reminders (such as 12-month pilot proficiency flight checks, operations manual reviews, ReOC renewals, and periodic maintenance intervals). These software triggers do not relieve the appointed Chief Remote Pilot of their legal duties under their approved CASA Operations Manual. The CRP remains personally and professionally responsible for ensuring all remote crew are appropriately trained, inducted, and compliant with current CASA legislative instruments.

3. Mandatory Incident Reporting (ATSB & CASA)

Under the Transport Safety Investigation Act 2003 (Cth) and CASA regulations, certain aviation occurrences are classification-mandated:

  • Immediately Reportable Matters (IRM): Fatalities, serious injuries, mid-air collisions, or aircraft loss.
  • Routinely Reportable Matters (RRM): Near collisions, control-link losses with flyaways, or significant property damage.

Recording an incident in FlightLedger does NOT satisfy your legal obligation to submit a formal incident report to the Australian Transport Safety Bureau (ATSB) or CASA. Operators must submit mandatory occurrence reports directly to the ATSB via official channels (atsb.gov.au).

4. No Warranty of Regulatory Immunity

Using FlightLedger to log operations, JSAs, and flight hours does not guarantee that CASA, ATSB, WorkSafe, or any other regulatory body will find your operations to be fully compliant upon inspection or audit. You remain responsible for maintaining the accuracy and veracity of all entered logs. Learno Pty Ltd accepts no liability for any regulatory sanction, aviation infringement notice, penalty notice, or ReOC suspension or cancellation issued against your organisation.
